truck with no title options

going on 2 years ago I bought a truck, fairly nice ford L7000, at an auction. at the auction they stated it had a lost title but the owner would get it for us. well I bought it. the owner kept putting me off saying he would get it and I have offered to pay him extra for it. now he wont return my calls.   

anyone have any suggestions to get a title for it? my thoughts are to buy another cab with a title and swap it over but cost is high.

we are in Missouri.

1.  Have a title check run on it to verify that the former owner truly owned it and that it does not have a lien against it.

2.  Determine what the process and cost is in your state for obtaining a duplicate title.

2.  If the title is verified and clean, talk to the auction house about contacting the owner about the title, and let them know that all that he needs to do is to stop by a license office and request a duplicate title.

You might even want to check to see if you can fill out the duplicate title paperwork and have it mailed directly to him, and lean on the auction house to make the owner come through.

Otherwise, hire local counsel to send certified mail to both the auction house as well as the former owner stipulating that they will be sued if they do not come forth with the title.

An auction house will not want to have negative publicity associated with it for selling vehicles w/o titles.  It will reduce the potential sales prices of future vehicles for them, and thus their commissions, plus a host of other potential problems.

Here in Vermont (and I know at least one other state) if the vehicle is older than 15 years old, it does not need a title.
I had a 1987 Mazda RX7 I bought out of a field, no title. Had no issues registering it or selling it to a NH resident.

Maybe Missouri has a similar law? Or maybe the truck isn't that old?

Celliot covered it for some states. Next Call the board of auction Licence or regulation in your state. It will put pressure on them but at 2 years may be to late! Next look at "alabama title" its a company that gets tital for cars that do not have one. Not sure how it works but it is popular for antique cars.

In NH you don't need a title after 15 years but you need a recent registration, as our registrations have a sale section on the back.  We also need a home made bill of sale signed by the owner

Perhaps your Town Clerk or local DMV can offer an assistance.  I purchased a vehicle a few years ago and it too didn't have a title.  I checked with our Town Clerk and she gave me a lost title application to fill out.  I mailed it to the state DVM along with a check for the processing fee and about a month later I had the title.  Roger

I have done this with success twice. I live in Virginia.  We have an abandoned vehicle form that can be got from dmv. Fill it out certitied mail it to last known owner, if no response, or if they reply that they don't want it, the dmv issues you a title in your name.

I had one guy respond saying he wanted it back, for free, I told him it was $50 a day for the last 14 months was owed. And he kindly released the title to me.

Good luck, it shouldn't be hard to get. Maybe 3 months process.

The main document you will need is a bill of sale from the seller and the auction company. I'd go after the auction company as well. Also, talk to the DMV and tell them your story. They can look up the VIN number and tell you the history of the vehicle ownership.

If you go to the DMV with the VIN number and the truck was ever stolen you will be escorted out by the State Police ( a friend of mine had this happen ). As the auction company sold you the truck they may be able to get a title as a dealer and then transfer it to you fairly easily because they were the seller of the vehicle and would most likely just need a signature of the previous owner.

Wondering how you can be so assured of the state police action, since you're in NY and the truck is in MO.  Every state is a different animal.   ;)

Crossed my mind too that the paperwork (title) may not be available because the truck may have been stolen somewhere along the line.
But am sure the police would be "somewhat" understanding, just that the truck may get shipped back to the rightful owner who has the title.

Hey Larry. I would talk to the auction co since it is against the law to sell a truck at auction without a title. Next step would be to have a lawyer send a letter to the owner. You can call the DMV or have a Police buddy run the vin and see who the title's name is in. 2 yrs is a while though. Not many alternatives here. If he is in the same county as you and you know a deputy maybe he could give the guy a call and tell him he needs to get the title straightened out. Here is my take. He never put the title in his name when he bought it and now he owes the 250.00 late fees plus taxes to get the title put in his name. Run the VIN and see who actually owns it.

thanks for the ideas! its my own fault for letting it go on so long.  im certain it was never stolen I semi know the guy whos auction it was. Missouri is a hard state to deal with titles. at the dmv they told me to not buy the vehicle after I told them I already have. im not a lawyer type person. I found a possible lead on a website. if I cant get it I will turn it into a new project. maybe retrofit a 40s or 50s body on it. it has a great running 3208 cat good trans new tires all around. too good to just let it sit.

I went through that same thing twice in Mississippi. I did have a notarized bill of sale in both cases. Had to post a title bond with the dmv. The bonding co. ran a stolen vehicle check. Painless and not terribly expensive.

There are vin trackers online. You should be able to run it yourself.

In NY it was no longer considered a DMV problem it was called possession of a stolen vehicle from the federal database and became a criminal action even though my friend had no idea it was previously stolen. I think that would be the same in all 50 states. It most likely is not the problem here, but it happens a lot.
