around here ALL land is posted.  don't have to have a sign.  no on can legally hunt, or tresspass on your land without written permission. lots of the larger tracts are tied up with hunting clubs. this came about by too many hunters, four wheelers, and four wheel drives abusing the land.  if you do get on somebody's property, you're liable to come out facing a law, a game warden, or an angry landowner with a shotgun.

gotta work something out here, essentially he built me a hunting camp, complete with a garden and a cleared pasture.
im thinking of proof of purchase(materials into the camp), rent, taxes on what hes soaked up for land, minus an hourly wage at the barn. lots of stipulations and id hate to say'lawer'
cant run a freind off that gave so much and has taken so little
but when you deal with govt money that drags so many strings......
seems if it was back before the 30s, id be happy to let someone who was more than appreciative squat, but were so tangled up on who does what and where do you sign this that our spirit is busted up into communisim,

Maybe you could work out some sort of lease agreement with the guy, if you want to protect yourself, while not losing the friend or the benefits of having him there.  A good lease contract gives him the legal right to be there, prevents him from claiming the land in the future, and describes what he can, and cannot do.  It also should help release you from some of the liability issues.  A personal contract like this may not be airtight in court, but will go a long way toward establishing what the intent of the relationship is.  That would be the "prior intent" factor that Tom mentioned.

Brian I got to agree. Red, knock it off. If you want to start a post about something, fine, but quit playing language games or whatever it is you do. Its a waste of our server space and most of our time when it takes two days to figure out what the hell your talking about. As interesting as some of this stuff is, find a better way to present it or these threads will get deleted before they have a chance. Thats what Tom was talking about in the first place.

Squatters on your land are trespassers. Unless you have a different definition for em  .  

You did ask about the law.  
My post gave you the only lawful way of dealing with them in NY.
Birdshot is not an option unless you want Uncle Randy to provide free housing for you   .

Your post went from squatters to a disagreement between an acquaintance.  The same law still applies.

Well I don't know much about this but I do know in some states there is something called "Adverse Possession" where someone can legally take your property by using it without your permission for a certain period of time. I think this is what was mentioned above. You might want to check into this a little more as some people are pretty unscrupulous.

That can happen in NY on unimproved property. If the person can show that they have maintained the property for at least 10 yrs., they might be able to take possesion of it. This happens mostly in housing developments where a building lot is left unimproved.

The way to protect your property from this happening to you, is too properly post against trespass .

You aint getting kicked or bruised. Your getting woke up is all. We had a little talk once before about this if you remember.

One thing to be careful of especially when people use your farm land is to make sure that they sign a liability waiver. If you don't "Mr squatter" and his kids get injured on your land.. it aint your land no more..Another thing is be nice, set the limits on the interaction by telling him you appreciate all he has done, but only he can hunt here and he can't live there. Personally I don't let anyone hunt or fish our farm..one bad day and your land is gone.

How to deal with squatters:

Actually, I am not sure you have a squatter, but they could become one with you don't legalize it.  

What you do have is a sharecropper from what I can tell. A person who works your land and gives you some of the proceeds is a sharecropper. You still own the land, but they have usuage of it for some return to you.

A squatter is a person who sneaks in while your land is vacant (or by force) and "improves" your land to such a degree that they can claim that the land was abandoned and therefore they have a right to it because they have taken care of it.

These laws generally are quite old and usually date from when the states were not so well settled.

So, even though you do not like the law or lawyers, if you do not want to wake up someday and find you do not have your land, get it in writing. If the person does not want to, have them evicted.

Just so the person remains friends, I just tell them that you know how society is, everyone suing everyone else.

By the way, squatters are a real problem in Costa Rica. In 3 months time they can have some rights to your land. However, they never bother land that is active, only land that is left alone. This of course means many a foreignor goes to Costa Rica and buys land, ignores it and then comes back the next year and finds they don't own it anymore.

Eighty percent of the land in Costa Rica is owned without title, it is just starting to change. The reason is that about 30 years ago, much of the country was still rainforest. To claim land, all you had to do was clear the jungle and plant something, which would take at least 3 months!  

Now the government will protect your land from squatters and they have no rights to your land if you are filed under the law for reforestation. Isn't life strange? Thirty years ago, you could claim land by improving it by cutting down all of the trees, now you improve land by letting the trees grow!

If you have full ownership to the property, I'm not sure why you are condoning squatters on your land. By allowing the practice, you are slowly giving up your property rights.
